संपत्ति का बेईमानी से दुर्विनियोग

जो कोई बेईमानी से किसी जंगम संपत्ति का दूर विनियोग करेगा या उसको अपने उपयोग के लिए सम परिवर्तित कर लेगा वह दोनों में से किसी भांति के कारावास जिसकी अवधि 2 वर्ष तक की हो सकेगी या जुर्माने से या कारावास से किसी में से दंडित किया जाएगा या दोनों से दंडित किया जाएगा।

  • राम, श्याम की संपत्ति को उस समय जबकि राममुस संपत्ति को लेता है यह विश्वास रखते हुए कि वह संपत्ति उसी की है श्याम के कब्जे में से सद्भाव पूर्वक ले लेता है राम चोरी का दोषी नहीं होगा किंतु यदि राम अपनी भूल मालूम होने के पश्चात उस संपत्ति को बेईमानी से अपने लिए विनियोग कर लेता है तो वह इस धारा के अधीन अपराधी घोषित होगा और इस धारा के अधीन दंडित किया जाएगा।
  • राम और श्याम एक घोड़े की साझीदारी में स्वामी है राम उस बूढ़े को उपयोग में लाने के आशा से श्याम के कब्जे में से उसे ले जाता है यहां राम को उस घोड़े को उपयोग में लाने का अधिकार है इसीलिए वह उसका बेईमानी से दुर्विनियोग नहीं है किंतु यदि राम उस घोड़े को बेच देता है और संपूर्ण आगम का अपने लिए भी नहीं हो कर लेता है तो वह इस धारा के अधीन अपराधी दोषी सिद्ध होगा।
  • राम जो श्याम का मित्र है श्याम की अनुपस्थिति में श्याम के पुस्तकालय में जाता है और श्याम की अभिव्यक्त संपत्ति के बिना एक पुस्तक ले जाता है यहां यदि राम का या विचार था कि पढ़ने के प्रयोजन के लिए पुस्तक विलेने को उसकी श्याम की विवक्षित संपत्ति प्राप्त है तो राम ने चोरी नहीं की है किंतु यदि राम  बाद में उस पुस्तक को अपने फायदे के लिए बेच देता है तो वह इस धारा के अधीन अपराधी का दोषी होगा।

 जिस व्यक्ति को ऐसी संपत्ति पड़ी मिल जाती है जो किसी अन्य व्यक्ति के कब्जे में नहीं है और वह उसके स्वामी के लिए उसको संरक्षित रखने या उसके स्वामी को उसे प्रत्यावर्ती करने के प्रयोजन में ऐसी संपत्ति को लेता है तो वह न तो बेईमानी से उसे लेता है

और ना ही बेईमानी से उसका दूर विनियोग करता है और किसी अपराध का दोषी सिद्ध नहीं है किंतु वह ऊपर परिभाषित अपराध का दोषी है यदि उसके स्वामी को जानते हुए या खोज निकालने के साधन रखते हुए

अथवा उसके स्वामी को खोज निकालने और सूचना देने के युक्ति युक्त साधन उपयोग में लाने और उसके स्वामी को उसकी मांग करने को समर्थ करने के लिए उस संपत्ति की युक्ति युक्त समय तक रखे रखने के पूर्व उसको अपने लिए भी नियोजित कर लेता है तो ऐसी दशा में युक्ति युक्त साधन क्या है या युक्ति युक्त समय क्या है यह तथ्य का प्रश्न है ,

यह आवश्यक नहीं है कि पाने वाला यह जानता है कि संपत्ति का स्वामी कौन है यह की कोई विशिष्ट व्यक्ति उसका स्वामी है यह पर्याप्त है कि उसको भी नियोजित करते समय उसे विश्वास नहीं है कि वह अपनी संपत्ति है या सद्भाव पूर्वक यह विश्वास है कि उसका असली स्वामी नहीं मिल सकता है।

इसमें अपराध चल संपत्ति की बेईमानी से धांधली या इसे और अपने उपयोग में परिवर्तित करना है तथा इसमें सजा का प्रावधान 2 साल या जुर्माना या दोनों से दंडित किया जाता है

तथा यह एक गैर–संगेय अपराध है और जमानती अपराध है तथा यह सभी मजिस्ट्रेट के लिए विचारणीय मामला है तथा इसमें कोई समझौता नहीं किया जा सकता है।

Dishonest misappropriation of   property👇

Whoever dishonestly takes away or converts any movable property to his own use, shall be punished with imprisonment of either description for a term which may extend to two years,

or with fine, or with imprisonment of either description for a term which may extend to two years, or Both will be punished.

  • Ram takes Shyam’s property when Rammus takes the property in good faith from Shyam’s possession believing that the property belongs to him. Ram will not be guilty of theft but if Ram realizes his mistake, then Dishonestly appropriates property for himself, he shall be declared an offender under this section and shall be punished under this section.
  • Ram and Shyam are the owners of a horse in partnership. Ram takes that old man out of Shyam’s possession with the hope of using it,here Ram has the right to use that horse, that’s why it is not his dishonest misappropriation but If Ram sells that horse and does not get the whole proceeds even for himself, then he will be found guilty under this section.
  • Ram who is Shyam’s friend goes to Shyam’s library in Shyam’s absence and takes away a book without Shyam’s express property. If Ram has not stolen, but if Ram later sells that book for his own benefit, then he will be guilty of an offense under this section.

Whoever finds lying property which is not in the possession of any other person and takes such property for the purpose of preserving it for its owner or reverting it to his owner,

he shall neither dishonestly take it nor dishonestly misappropriates the same and is not convicted of any offense but is guilty of the offense defined aboveIf the property thereof is kept for a reasonable period of time by knowing its owner

or having the means of discovering it or using a reasonable means of discovering and giving information to its owner and enabling his owner to demand the same. employs it for himself before

In such a case what is a reasonable resource or what is a reasonable time, it is a question of fact , it is not necessary that the beneficiary knows who is the owner of the property, that some particular person is the owner of it,

it is sufficient that he should also When employed, he does not believe that it is his property or has a good faith belief that his rightful owner cannot be found.

The offense here in is dishonest misappropriation of movable property or its conversion to further use and is punishable with imprisonment for a term which may extend to two years or with fine or with both and it is a non-compoundable offense and is a bailable offense and shall be punishable by all magistrates. It is a matter for consideration and no compromise can be made in this.
